New Delhi, Feb 9: Trial Court judge Shyam Lal, who had convicted and sentenced Dr Rajesh and Dr Nupur Talwar in the Aarushi Talwar murder case, on Friday moved the Supreme Court seeking deletion of certain "personal" remarks made by one of the Allahabad High Court judges while pronouncing the judgement in the case.
Sakha Ram Singh, senior advocate appearing for the then Special judge said, yes the Special Leave Petition (SLP) has been filed in the apex court and the court also issued notice to the Uttar Pradesh Government and other parties and or respondents in the case.
A copy of the petition, filed by Shyam Lal, claimed that because of the adverse comments, made by one of the judges in the Allahabad High Court division bench, in his separate judgement, has seriously affected the reputation of the petitioner (Shyam Lal) as independent and impartial judge having decided many important cases which have been upheld by court.
One of the judges of the High Court constituting the division bench was not justified in passing disparaging remarks, unwarranted comments and criticisms against the petitioner, Shyam Lal, in its judgement and 2017 order.
The adverse comments made against the petitioner, without affording an opportunity of showing any cause was legally unjustified, the petition of Shyam Lal claimed. UNI
